AGREEMENT WITH THE CAMP PARTICIPANT’S REPRESENTATIVE. The agreement is concluded electronically, i.e., by marking that you have read and agree to the terms of the agreement in this online registration form. and
a parent, adoptive parent or guardian representing the interests of the camp participant (child) (hereinafter – the Camper) (hereinafter – the Camper’s Representative),
have concluded this agreement regarding the Camper’s participation in the children’s day camp organized by the Camp Organizer (hereinafter – the Agreement):
1. SUBJECT OF THE AGREEMENT
1.1. The Camp Organizer undertakes to organize an educational program “Gatvės gyvos vaikams” for the Camper in a day camp (hereinafter – the Camp).
2. OBLIGATIONS OF THE PARTIES
2.1. Obligations of the Camp Organizer:
2.1.1. To implement the educational camp program;
2.1.2. To foster the Camper’s creativity, independence, personal and social competencies, and to provide opportunities for communication and self-expression;
2.1.3. To ensure reasonable supervision, safety, and health protection of the Campers;
2.1.4. To insure the Campers against accidents; 2.1.5. To organize meals for the Campers twice per day, applying the same menu to all Campers during the Camp period. An individualized menu for a specific Camper shall be agreed only in cases of specific, real, and substantiated food intolerances, about which the Camper’s Representative has informed the Camp Organizer in writing no later than five (5) business days prior to the start of the Camp, and only if the Camp Organizer and the Camper’s Representative additionally agree in writing on the application of an individualized menu. The Camp Organizer reserves the right, after informing the Camper’s Representative, not to take any additional measures if the Camper refuses meals during the Camp without justified reasons;
2.1.6. To inform the Camper’s Representative within a reasonable period of time if the Camper becomes ill or an accident occurs during the Camp. For the sake of clarity, the Parties agree that, for the purposes of this clause, a reasonable period of time shall be deemed to be eight (8) hours from the moment the illness becomes apparent or the accident occurs.
2.2. Rights of the Camp Organizer:
2.2.1. If, during the Camp, it becomes apparent that the Camper has health disorders, special educational needs, emotional and/or behavioral disorders that have a significant negative impact on the Camper’s participation in the Camp program, negatively affect the involvement of other children, or interfere with or complicate the implementation of the Camp program, the Camp Organizer reserves the right, after informing the Camper’s Representative, to remove the Camper from the Camp before its end;
2.2.2. The Camp Organizer has the right to recover from the Camper’s Representative any material damage caused by the Camper to the Camp Organizer and/or other jointly acting third parties or other Camp participants;
2.2.3. The Camp Organizer has the right, at its own discretion and without separate notice, to change the Camp program taking into account weather conditions or other unforeseen circumstances;
2.2.4. The Camp Organizer may remove the Camper from the Camp, informing the Camper’s Representative, if the Camper fails to comply with the norms of safe and responsible behavior in the Camp: damages or appropriates Camp property or the personal property of other Camp participants, uses physical or psychological violence against other Camp participants, or by intentional, careless, or inappropriate actions interferes with the activities provided for in the Camp program.
2.3. Rights and obligations of the Camper’s Representative:
2.3.1. To inform the Camp Organizer in writing about any health disorders diagnosed by doctors, allergies, special educational needs, emotional and/or behavioral disorders of the Camper that should be taken into account by the Camp Organizer;
2.3.2. To ensure that the Camper brought to the Camp is healthy and does not suffer from contagious diseases;
2.3.3. To immediately inform the Camp Organizer if the Camper becomes ill;
2.3.4. To arrive at the Camp and depart from the Camp on time each Camp day. Daily Camp working hours are from 8:30 a.m. to 5:30 p.m. The Camp Organizer shall not be responsible for the supervision of the Camper outside Camp working hours. In the event of a late arrival, the Camper’s Representative undertakes to bring the Camper to the location indicated by the Camp Organizer where Camp activities are taking place;
2.3.5. To assume responsibility and compensate the Camp Organizer or other jointly acting third parties for direct and indirect losses arising from the Camper’s actions.
3. CONSENTS AND LIABILITY
3.1.1. The Camper’s Representative agrees that the Camper may participate in all tourism-related events/trips provided for in the Camp program and may travel on foot or by public transport;
3.1.2. The Camper’s Representative agrees that the Camper may visit public playgrounds in the city together with the group;
3.1.3. The Camp Organizer shall not be liable for health disorders of children or any damage arising from accidents occurring within the Camp or other areas visited during the Camp, except where such damage is caused by the fault of the Camp Organizer;
3.1.4. The Camp Organizer shall not be responsible for items left behind and/or lost by the Camper during the Camp and shall not compensate any losses incurred as a result thereof.
4. VALIDITY, AMENDMENT AND TERMINATION OF THE AGREEMENT
4.1. This Agreement shall enter into force upon signature and shall remain valid until full performance of the contractual obligations;
4.2. The Camp Organizer has the right to unilaterally terminate this Agreement without a notice period due to non-performance of the obligations of the Camper’s Representative or the Camper provided for in this Agreement and, after informing the Camper’s Representative, to remove the Camper from the Camp before its end if the Camper fails to comply with the norms of safe and responsible behavior in the Camp (Clause 2.2.4);
4.3. The Camper’s Representative has the right to terminate this Agreement by submitting a reasoned request to the Camp Organizer;
4.4. The Camp Organizer shall have no obligation to compensate any losses incurred by the Camper or the Camper’s Representative if the Camp is cancelled or this Agreement is terminated in accordance with the procedure established in this Agreement.
5. PROCESSING OF PERSONAL DATA
5.1. Personal data of the Camper and the Camper’s Representative provided at the time of concluding this Agreement – name, surname, e-mail address and telephone number – shall be processed solely for the purpose of ensuring the safety of the Camper and communication with the Representative when necessary (e.g., in case the Camper becomes ill, an accident occurs, or other urgent circumstances arise).
5.2. Personal data shall not be transferred to third parties, except in cases required by law or competent authorities.
5.3. Data shall be stored only for as long as necessary to achieve the purposes set out in this Agreement, but no longer than three (3) months after the end of the Camp.
5.4. Data subjects have the right to access their data, request correction, deletion, or restriction of processing, as provided for in the GDPR.
